RESPONSIBILITY
Registered Day Care
The provider fills out forms including a safety evaluation form stating provider is in compliance with all regulations. Registered daycares require yearly renewal.
Licensed Day Care
Compliance with safety and health standards within the home is determined by an initial visit conducted by the child care surveyor which includes:
- a self evaluation form filled in by the provider; and
- evaluations of safety and health standards by a child care facility surveyor.
NUMBER OF CHILDREN
Registered Day Care
Maximum of 6 children in the home at any one time is established by law. This total includes children birth to age 16 and the provider's own children under 12. Three of the 6 children may be under 18 months of age.
Licensed Day Care
Licensed Day Care Home:
* Maximum of 10 children, infancy through 16 years of age with a limited number of children under kindergarten age. This number includes the provider's own children under 11 years of age.
Group Day Care Home: * Maximum of 12 children with second adult.
HOME VISITS
Registered Day Care
No registration inspection is made by the child care facility surveyor on behalf of the state, prior to issuance of a Certificate of Registration, unless there is a request by the applicant or there is a complaint. KDHE has the right of entry to check compliance after receiving either an oral or written complaint. Counties or Cities may have codes or ordinances requiring an inspection and approval for legal operation of the registered home.
Licensed Day Care
A licensing inspection is conducted at least one time annually and upon receiving a complaint.
